The following Terms of Service apply when you use Fokaweather Data (the “Service”), and the Fokaweather.com website (the “Site”) provided by Fokasoft (the “Company”). Please review the following terms carefully. By accessing or using the Service or the Site, you signify your agreement to these Terms of Service. If you do not agree to these Terms of Service, you may not access or use the Service or the Site. The Company may terminate your use of the Service and/or take appropriate legal actions if you violate these Terms of Service.

Unless you notify us otherwise in writing, we may identify you as a customer and user of the Service on our website, mobile application and in other online or offline marketing materials and press releases, and we may publish case studies and other marketing materials related to your use of the Service. We acknowledge that your company name and logo are protected by intellectual property rights. You hereby grant to the Company a non-exclusive, royalty-free and fully paid up license, during the Term, to use your name, logo, and website URL, on our website, mobile application and in other online or offline marketing materials relating to the Service. We will use this content strictly in accordance with any usage guidelines you provide to us.
Violations of our Terms of Service will result in a permanent ban from the Site and Service, and legal action as deemed appropriate.
There are some non-accepted uses for our data. Use of our data for any of the following will lead to immediate restriction of its use:
You agree to pay the full price for the service you purchase from the Website under conditions set out in the price-list. We reserve the right to charge extra charges for your credit card for any products purchased from the Website. You are responsible for the timely payment of all subscription fees, and other fees with a valid credit card. The Company reserves the right to modify the subscription fees upon notice of such modifications to ongoing subscribers from time to time, as to periods for which such fees have not yet been paid. No refunds will be given after payment for the subscription has been made (except in cases of erroneous billing). It is the customer's responsibility to ensure they cancel a plan they no longer want to continue by either logging in, and disenrolling, or contacting support@fokaweather.com. The date of any cancellation request receipt will be considered the plan termination date. Any additional payments after this cancellation request has been made, will be refunded in full.
You may cancel the service at any time, and you will not be billed for additional subscription periods. We will not issue refunds for partially complete subscription periods. The free version of our service is to be used to trial, and evaluate the service and it's features. It is during this period that you should evaluate, and decide if the service is right for your needs.
Accounts that are not actively enrolled in a paid subscription, AND have not logged in after 6 months are disabled. If a user desires to re-activate their account, or keep the account active they must login at least once every 6 months.
We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any material on our site is subject to change, and may not be up to date. We carry no obligation to update material on the site.
The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, and third parties connected to us hereby expressly exclude:
If you seek to file a legal claim against us, you agree to file and resolve it exclusively in the court located in Singapore. You also agree that the laws of Singapore will govern these Terms of Service, as well as any legal claim that might arise between you and us (without reference to conflict of laws principles). THE FOKAWEATHER SERVICE AND THE DATA PROVIDED BY THE FOKAWEATHER SERVICE IS NOT INTENDED TO BE USED IN ANY APPLICATION WHERE HUMAN LIFE OR PROPERTY MAY BE AT STAKE, YOU WAIVE ANY CLAIMS FOR LIABILITY OR INJURY FOR SUCH USE. FOKASOFT WILL NOT BE LIABLE TO YOU OR TO ANY OTHER PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER YOU WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
You shall indemnify and hold harmless the Company from and against all claims and liabilities (including claims by third parties) and costs and expenses (including attorney’s fees) incident thereto or incident to successfully establishing the right to indemnification, for injury or death of any person or persons, including your employees, if any, arising out of or in any way relating to your breach of the terms of this License and/or your utilization of the Service, whether or not arising in tort or occasioned by the negligence of the Company, except to the extent of any obligation, liability, claim or remedy in tort due to the recklessness or willful misconduct of the Company. We process information about you, and your use of the Site and Service in accordance with our privacy policy. By using our Site, or Service you consent to such processing and you warrant that all data provided by you is accurate.
You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.
By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them. We may from time to time revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our site.
Billing is handled on a Per Month, or per use basis. For both, a payment source is required, and stored by our 3rd party payment processor: Stripe.com. Payment is required before usage of any paid plan. Payment for non-monthly plans are done on a per-use basis, and can be due either upon issuance of service, or at the end of the billing month.
No refunds will be provided after service has been rendered.
No refunds or credits will be issued when a user decides to downgrade their subscription from a higher cost plan, to a lower cost plan. If a user subscribes to a lower cost plan after enrolling in a higher cost plan, the new lower rate will be billed at the end of the billing cycle. The new lower rate will apply to future billing cycles. Any plan changes take affect upon downgrade, it is up to the user to make sure that they that they have used any remaining quotas before downgrade.
If a user decides to upgrade their plan, after having paid for a full month of the prior plan. Payment only for the difference in plan pricing for the current will be required. Any future months will be billed at the new rate.
